Terms of Service – PokeKingShop Inc.

Effective Date: 4/30/2026

By accessing, purchasing from, or using any services provided by PokéKingShop Inc. (“Company,” “we,” “us,” or “our”), you agree to be legally bound by these Terms. If you do not agree, do not use our services.

1. ALL SALES ARE FINAL

Due to the nature of collectible products:

  • No refunds
  • No returns
  • No exchanges
  • No cancellations

All purchases are final upon order confirmation, without exception.

2. COLLECTIBLE PRODUCT DISCLAIMER

You acknowledge:

  • Market prices are highly volatile and speculative
  • Product condition may vary due to manufacturer quality
  • We do not guarantee grading outcomes (e.g., PSA, Beckett)
  • Pull rates, contents, and card conditions are random and not guaranteed

You assume all risk when purchasing.

3. SEALED PRODUCT & TAMPERING POLICY

  • All sealed products are sold factory sealed as received from distributors
  • PokeKingShop Inc. does not tamper, weigh, map, reseal, or alter products in any way
  • Once a sealed product is opened, it is immediately ineligible for any claim, dispute, or review

By purchasing sealed products, you agree:

  • You are buying for collectible and entertainment purposes only
  • You understand that outcomes are random and may not meet expectations
  • You waive any right to claim that products were “tampered with,” “searched,” or “unfair”

Any false claims of tampering will be considered fraudulent.

4. ASSUMPTION OF RISK

You expressly agree:

  • All purchases are made at your sole risk
  • You will not hold PokeKingShop Inc. responsible for:
    • Market losses
    • Card values declining
    • Unfavorable pulls or outcomes

5. SHIPPING & RISK OF LOSS

  • Risk transfers to the customer once the order is handed to the carrier
  • We are not liable for:
    • Lost, stolen, or delayed packages
    • Carrier mishandling or damage

Customers must resolve shipping issues directly with the carrier.

6. ORDER ACCURACY

You are responsible for:

  • Correct shipping information
  • Correct order selection

We are not responsible for errors made at checkout.

7. FRAUD & ORDER CONTROL

We reserve full authority to:

  • Cancel any order at any time
  • Refuse service to any customer
  • Limit quantities
  • Hold orders for fraud review

No explanation is required.

8. CHARGEBACKS & DISPUTES

You agree:

  • Not to initiate chargebacks without contacting us first
  • That chargebacks made in violation of this policy constitute fraudulent activity

We reserve the right to:

  • Permanently ban customers
  • Submit evidence to payment processors
  • Pursue legal recovery of funds, fees, and damages

You agree to cover all associated costs, including legal fees.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • PokeKingShop Inc. is not liable for any indirect, incidental, or consequential damages
  • This includes loss of profits, investment losses, or dissatisfaction

Maximum liability is strictly limited to the amount paid for the product.

10. INDEMNIFICATION

You agree to defend and hold harmless PokeKingShop Inc. from:

  • Any claims, disputes, or legal actions
  • Any misuse of products or services
  • Any violation of these Terms

11. BINDING ARBITRATION & WAIVER OF LAWSUITS

  • All disputes must be resolved through binding arbitration, not court
  • You waive any right to:
    • File a lawsuit
    • Participate in a class action

Arbitration will take place in the State of Illinois.

12. GOVERNING LAW

These Terms are governed by the laws of the State of Illinois.

13. MODIFICATIONS

We may update these Terms at any time without notice. Continued use = acceptance.
